Karen Bernofsky has advised and acted for clients in a wide range of civil litigation matters, including complex insurance matters, commercial disputes, such as breaches of contract and invoice disputes, and construction matters. Her clients include directors, officers, and shareholders where she handled disputes and potential liability issues, as well, she has advised clients on privacy and cyber risk issues, and acted for both plaintiffs and defendants in claims for intentional torts, such as fraud and intrusion upon seclusion (also sometimes referred to as breach of privacy), and defended professionals against complaints to courts and administrative bodies, such as colleges and tribunals.

As a strong litigator, Karen has extensive experience before various levels of courts and administrative tribunals in Ontario as well as the Federal Court. She has represented plaintiffs and defendants at trials, appeared successfully on complex and difficult to win motions, and acted in appeals to the Divisional Court and Court of Appeal. Karen’s unusual background has helped to hone her drafting and research skills, and she has always had strong advocacy skills, whether it was defending her PhD thesis or in moots and skills competitions in law school. Amongst the many successes and honours she received, she placed second at the prestigious national Gale moot after arguing an appeal before Justices of the Supreme Court of Canada and Courts of Appeal.

Karen puts her advocacy skills to work in the courtroom and in negotiations and mediations, including when facing difficult and intransigent opposing parties. In addition to her experience as a lawyer, she has also acted as a mediator, which has provided her with insight into effective mediation advocacy.

First and foremost, Karen sees herself as an advisor with the goal to find effective and economical solutions, provide her clients with all the information and advice needed to make the best decisions for their unique circumstances, and then to use her skills and expertise to achieve the sought-after result.

When not at work, Karen enjoys streaming TV shows and belting out 70s, 80s, and 90s hits with friends at karaoke.
