Litigation loans with exorbitant interest rates have become a way for plaintiffs to fund their lawsuits, with adverse cost insurance to shield against cost awards following a poor trial result. We will explore both in the Canadian and US context, including how they work, disclosure obligations, the plaintiff's ability to pass the cost to the defendant, and the defence response. The rules vary from Province to Province, and State to State. This is a topic worth exploring.
